These Terms of Service ("Terms") govern your use of the I Am Alivemobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, please do not use the App.

2. Description of Service

I Am Alive is a safety check-in application designed for individuals living alone. The App allows users to perform daily check-ins and designate trusted emergency contacts ("Trust Circle") who are automatically notified if a check-in is missed. The App also provides gamification features, an AI companion chatbot, and voice-based check-in capabilities.

3. Account & Authentication

  • The App uses anonymous authentication. No email, password, or personal identity is required.
  • Your account is tied to your device. If you uninstall the App or change devices, your data may not be recoverable.
  • You are responsible for maintaining the security of your device and access to the App.

4. Trust Circle & Emergency Contacts

  • You are solely responsible for the accuracy of the contact information you provide for your Trust Circle.
  • By adding contacts, you represent that you have their consent to share their phone number and to receive emergency notifications from the App.
  • The App will send automated notifications to your Trust Circle contacts when escalation is triggered. You acknowledge and agree to this automated communication.

5. Important Disclaimers

5.1 Not a Replacement for Emergency Services

The App is NOT a substitute for emergency services (e.g., 911, 112, 999). In any life-threatening situation, always contact your local emergency services first. The App is designed as a supplementary safety tool and does not guarantee emergency response.

5.2 No Guarantee of Delivery

While we strive to ensure reliable notification delivery, we cannot guarantee that alerts to your Trust Circle will always be delivered successfully. Factors such as network availability, device settings, and third-party service outages may affect delivery.

5.3 Offline Functionality

The App is designed to work offline; however, Trust Circle notifications require an active internet connection. Check-ins performed offline will sync when connectivity is restored, but escalation alerts cannot be sent without internet access.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful or fraudulent purpose
  • Deliberately trigger false emergency alerts to your Trust Circle
  • Attempt to manipulate streaks, leaderboards, or gamification features through automated means
  • Reverse-engineer, decompile, or tamper with the App
  • Use the App to harass, threaten, or harm others
  • Impersonate another person or misrepresent your identity

7. AI Companion (Alive Bot)

  • The AI companion is designed for general emotional support and entertainment purposes only.
  • Alive Bot is not a licensed therapist, counselor, or medical professional. Its responses should not be considered medical, psychological, or professional advice.
  • If you are experiencing a mental health crisis, please contact a professional helpline or emergency services immediately.

8. Intellectual Property

All content, features, branding, and functionality of the App — including but not limited to text, graphics, logos, icons, badges, and software — are the property of I Am Alive and are protected by applicable intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by applicable law, I Am Alive and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

  • Failure to deliver notifications or alerts
  • Loss of data or check-in history
  • Reliance on AI companion responses
  • Any harm arising from the use or inability to use the App

10. Indemnification

You agree to indemnify and hold harmless I Am Alive, its developers, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
